Terms and Conditions

By ordering the list, you hereby understand and agree to abide by the following terms and conditions. 

1. SAMPLE MAILING PIECE REQUIRED - All mail pieces MUST be approved by the list owner.  Furthermore, ANY and ALL changes to your mailing piece MUST be approved.  The reason for this is non-compete contracts the list owner has with other business groups.  Mail pieces are to be submitted to Mary Tobin.  The following formats can be emailed: PDF, .jpg, Word or MS Publisher document. Send to Mary@storklady.com. Be sure your first and last name are in the email you send that has your mail piece attached! You will not be added until your current mail piece has been approved. EMAILS ONLY! Sorry, but snail mail samples are not accepted.

2. ONE TIME USE ONLY  - It is understood that this rented mailing list is being rented for a one time use only and will not be re-used, re-mailed, exchanged, resold, or entered into a database. 

3. Audit Label - Periodically, the list supplier and/or The Stork Lady may insert a test label in your subscription for the purpose of auditing the mailing pieces and verifying the integrity of The Stork Lady subscription group.  It is understood that any labels in your mailing group that are out of your geographical area MUST be mailed as a normal mailing piece.

4. Warranty - The Stork Lady does not warrant that the data is error free.  Neither The Stork Lady or its suppliers make any warranties, expressed or implied, including without limitations those of merchantability and fitness for a particular purpose with respect to the information provided hereunder.  It is expressly understood and agreed that no guarantee of results has been implied by The Stork Lady and that The Stork Lady shall not be liable for any loss of profits or for special, consequential or exemplary damage resulting from the use of lists rented or purchased hereunder.

5. Guarantee – We can NOT guarantee the list as accurate. You will receive some back each month as undeliverable.

6. Limit of liability - The Stork Lady submits each list to the vendor according the customers exact specifications.  Therefore, no list is returnable.  The Stork Lady’s liability for errors is limited to replacing the list or refunding the cost of the list, whichever is less.  By placing an order, customer acknowledges this limit of liability. 

7. Deposit required - a $50.00 subscription deposit will be charged to your credit card upon receipt of your subscription order. Should you cancel your subscription, your deposit will be refunded.

8. Payment terms: Automatic billing to a Visa or MasterCard kept on file. You may print and fill in the following receipt or use your credit card statement as your receipt. Receipt

9. Penalties for Violation:  Because one violation could impact the entire group, penalties for any violation of these terms and conditions will immediately result in the following:

1. Forfeiture of Security Deposit
2. Cancellation of Mailing Label Subscription
3. Termination of The Stork Lady Partnership
